Terms and Conditions of Use

These terms and conditions of use (hereinafter referred to as the "Agreement") set forth the terms and conditions for the use of this NFT and applies to all those who purchase and use this NFT.

■Applicability This Agreement shall be concluded between the seller and the holder regarding the purchase and use of this NFT.

■Definitions The following terms used in this Agreement shall have the meanings set forth below:
1."This Artwork Data": Data (including but not limited to mp3, jpeg, Etc.) associated with this NFT as defined in the following clause.
2."This NFT": A Non-Fungible Token recorded on a blockchain that allows the holder, within the scope defined in this Agreement, to use the Artwork Data licensed by other relevant parties or us.
3."Holder": A person who has legally purchased and obtained this NFT in accordance with this Agreement.
4."Intellectual Property Rights": All patents, utility model rights, trademark rights, design rights, copyrights (including the rights under Articles 27 and 28 of the Copyright Act), and other intellectual property rights (including the right to apply for such rights and to carry out procedures such as registration, renewal, extension, Etc. concerning such rights) in any country, state, region or jurisdiction.
5."Anti-Social Forces": Any organization or its members that engage in anti-social activities, including but not limited to organized crime groups, members of organized crime groups, persons who have not passed five years since ceasing to be members of organized crime groups, quasi-members of organized crime groups, companies affiliated with organized crime groups, extortionists, social movement extortionists, political activity extortionists, special intelligence violence groups and other anti-social forces.
6."Laws and Regulations": Laws, government ordinances, directives, rules, orders, bylaws, guidelines, and other regulations.

■Scope of Use The holder may use the acquired This NFT and This Artwork Data free of charge for exhibiting and screening in art exhibitions and personal websites and social media icons. Posting on social media or video-sharing sites is allowed only for content related to the author or the point of purchase.
Any commercial use of the Artwork Data is strictly prohibited. This includes, but is not limited to, posting artwork or parts thereof for profit, reproduction of artwork, distribution for profit, commercialization using artwork (including screenshots), and provision of artwork images to third parties (including those for research and development purposes).
In using Artwork Data for display, posting and other purposes, please do not include any content that violates public order and morality or defames or slanders the copyright owner or others.

■Prohibited Conduct The holder of this NFT shall not engage in the following activities related to the purchase, use, or transfer of This NFT:
1.Any act that violates this Agreement.
2.Any act that violates laws and regulations or is related to criminal activities
3.Any act that uses this NFT as a means of payment, remittance, or settlement.
4.Any act that uses this NFT to distribute profits.
5.Any act of fraud or coercion against us or a third party.
6.Any act that goes against public order or morals.
7.Any act related to anti-social activities or providing benefits to anti-social forces.
8.Any act that infringes upon the intellectual property rights, portrait rights, privacy rights, honor, or other rights or interests of us or a third party.
9.Any act that defames or slanders a third party or us.
10.Any act of duplicating, selling, publishing, or otherwise using the artwork data and NFT, except as expressly permitted by this Agreement or otherwise authorized by us.

■Amendment of this Agreement These terms and conditions of use ("Agreement") shall apply between the holder of this artwork and the Agreement Setter specified at the end of this Agreement. The owner of the artwork and the Artwork Agreement Setter may modify the contents of this Agreement by mutual Agreement.

■Governing Law These Terms and Conditions shall be interpreted and applied in accordance with the laws of Japan.
